Groundcraft legal
Terms of Service
What you can expect from us, and what we expect from you.
In force 12 August 2026 · Version 1.0
Operator: Mind Hack, Inc., a Delaware corporation, 651 N Broad St Ste 104, Middletown, DE 19709-6401, United States (“Groundcraft,” “we,” “us”). All prices are in US dollars.
Effective date: 12 August 2026. Version: 1.0.
These terms govern your use of the Groundcraft platform at groundcraft.dev: managed WordPress hosting, growth tooling, done-for-you website builds, and related services for small businesses. By creating an account or purchasing a plan you agree to these terms, our Privacy Policy, and our Refund & Cancellation Policy. If your sites collect personal data from visitors, our Data Processing Addendum also applies and forms part of these terms.
1. Your account
You need an account to use Groundcraft. Keep your login credentials secure; you are responsible for activity under your account. You must provide a working email address — it is how we send invoices, renewal notices, and service notices. Accounts are for businesses and adults; Groundcraft is not directed at children.
2. Plans and what they include
Hosting is sold as a monthly subscription. Each plan includes a maximum number of hosted sites and a set of platform features:
| Plan | Price / month | Sites |
|---|---|---|
| Launch | $12 | 1 |
| Solo | $20 | 2 |
| Studio | $60 | 12 |
| Scale | $100 | 25 |
| Agency | $249 | 60 |
| Foundry | Custom — invoiced, not self-serve | Custom |
Add-ons are separate monthly subscriptions attached to your account: Mailee (email + newsletters, $15/mo), Reviews & Reputation ($19/mo), and Prospector (lead mining + outreach, $49/mo).
White-label management for agencies is sold in packs with a ten-site minimum: 10 sites $70/mo, 25 sites $150/mo, 50 sites $250/mo, 100 sites $400/mo. Above 100 sites the rate is agreed in writing. There is no single-site white-label price.
Some AI-powered features are metered and consume AI credits. Where a feature consumes credits, the platform shows the cost before you run it. Credit treatment on refunds is covered in the Refund & Cancellation Policy.
Feature sets per plan are described on the pricing page at the time of purchase; we may improve or adjust features over time, but we will not materially reduce what your current plan includes mid-billing-period.
3. Payment
Payments are processed by WooCommerce Payments, which runs on Stripe. Your card details are entered directly into Stripe’s payment element and never touch Groundcraft’s servers. We store only what we need to run your account: the subscription record, invoice history, and a payment token held by Stripe.
4. Renewal
Subscriptions renew automatically each month on your billing date, at the then-current price for your plan, until you cancel. You can cancel any time from your account portal; cancellation takes effect at the end of the current billing period. There is no proration of a partial month — see the Refund & Cancellation Policy §1.
If we change a plan’s price, we will notify you by email at least one full billing cycle before the new price applies to you.
5. Failed payments, dunning, and suspension
If a renewal charge fails, we retry it automatically and email you so you can update your card. We retry over seven days. If payment still fails after that window, we suspend the account: your sites stop being publicly served and platform features lock, but your content is not deleted. Once payment succeeds, service resumes.
A suspended account stays recoverable for 30 days. If it is still unpaid at the end of that period, we may terminate it under §11 — at which point the post-termination window in §11 begins.
6. “Website, built for you” — the build plans
A build plan (Ignition $399, Orbit $699 or Apollo $1,199) is a one-time, fulfilled service, not a subscription. The finished site is hosted by us; year one of hosting is included in the plan, and hosting continues from $19/mo after that. It works in stages:
- Intake. You complete a short intake (business details, content, brand preferences). The build clock starts when intake is complete, not at purchase.
- Build. We build the site. Our target is a fast turnaround (we aim for days, not weeks), but the target is not a guarantee — build time depends on the completeness of your intake. We email you when the build starts; that email is the moment work begins, and it is the boundary the refund ladder turns on.
- Review. We send you the built site for review. The service includes one round of revisions within the original scope — copy tweaks, image swaps, layout adjustments. New pages, new features, or a change of business direction are out of scope and quoted separately.
- Handoff. After revisions (or your approval), the site is yours: it runs on your plan and you own the content (§9).
If you go quiet. If we cannot get a response from you at intake for 30 days despite reasonable attempts to reach you, we pause the engagement and hold your purchase — nothing is lost, and you can pick it up whenever you are ready. If we cannot get a response after we have delivered the site for review for 14 days, we treat the build as accepted, complete the handoff, and close the engagement. The refund consequences of each stage are set out in the Refund & Cancellation Policy.
7. Acceptable use
You may not use Groundcraft to host or transmit:
- anything illegal under US law or the law that applies to you;
- malware, phishing pages, or infrastructure for attacking other systems;
- spam, or content that exists to game search engines with no value to a human reader (we build SEO tooling; we do not host link farms);
- content that infringes someone else’s intellectual property;
- material sexualizing minors — zero tolerance, immediate termination and reporting where required by law;
- anything that materially degrades service for other customers (e.g., using a hosting plan as bulk file storage, a proxy, or a crypto miner).
We may suspend a site immediately where we believe in good faith it violates this section, and will tell you why unless the law prevents it.
8. Service levels — an honest statement
We run managed infrastructure and take uptime seriously: monitored servers, nightly backups on every plan (hourly on Scale and above), and operations that treat outages as emergencies. But we are a small provider, and we will not publish an availability percentage we have not measured over a sustained period.
Accordingly, we offer no formal SLA and no service credits. Foundry customers may negotiate a custom SLA in their order form. If we adopt a published SLA later, it will be added here with real numbers and an effective date.
What we do commit to: scheduled maintenance announced in advance where practical, and honest status communication during incidents.
9. Your content is yours
You own the content of your sites — text, images, data, design choices, lead submissions your forms capture. You grant us only the license we need to host, back up, cache, display, and transmit it to run the service. We claim no ownership and will not reuse your content to promote other customers without your permission.
The Groundcraft platform — our software, themes, builder, tooling, and brand — remains ours. Your plan is a license to use it while subscribed, not a transfer.
Content generated for you by platform AI features is yours to use; you are responsible for reviewing it before publishing, as with anything else on your site.
10. Your site visitors’ data
If your sites collect personal data from visitors (contact forms, lead capture, bookings), you are the data controller for that data and Groundcraft processes it on your instructions. The Data Processing Addendum governs that relationship, including the subprocessors involved and what happens to visitor data when you leave.
11. Termination, export, and deletion
You can leave any time. Cancel self-serve; service continues to the end of the paid period. WordPress is portable by design — you can export your site content (standard WordPress export, plus database and file export on request) at any time while your plan is active.
After termination (by cancellation, non-payment under §5, or by us under §7): your sites stop being served. We retain your content and backups for a post-termination window of 30 days, during which you can request a full export. After the window, we delete your site content and backups from our systems in the normal course of operations. Account records we must keep (invoices, tax records) are retained as described in the Privacy Policy.
We can terminate for material breach of these terms (with notice and a chance to fix it, where fixable), for the acceptable-use violations in §7 (immediately where warranted), or for non-payment.
12. Disclaimers
The service is provided “as is.” We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the extent the law allows. We do not warrant that the service will be uninterrupted or error-free (see §8), or that SEO and growth tooling will produce any particular ranking, traffic, or revenue outcome — no honest provider can promise search rankings.
13. Limitation of liability
To the extent the law allows: neither party is liable to the other for indirect, incidental, special, or consequential damages, or lost profits. Our total liability for any claim arising out of the service is capped at the fees you paid us in the 12 months before the event giving rise to the claim. Nothing in these terms limits liability that cannot lawfully be limited.
14. Indemnification
You will defend us against third-party claims arising from your content or your use of the service in violation of these terms, and cover resulting damages finally awarded or agreed in settlement. We will notify you promptly and cooperate reasonably.
15. Governing law and disputes
Talk to us first. Before filing anything, email us and give us 30 days to put it right. Most disputes about a $399 build or a $19 hosting month are misunderstandings, and they are cheaper and faster to fix in an inbox than in a courtroom. We take that obligation on ourselves too.
If that fails: these terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute arising out of these terms or the service.
Small claims carve-out. Either of us may bring an individual claim in a small-claims court with jurisdiction, wherever that is — nothing above is meant to price a small customer out of a small remedy.
We do not require arbitration and we do not ask you to waive a class action.
16. Changes to these terms
We may update these terms. For material changes we will email account holders at least 30 days before the change takes effect; continuing to use the service after that date is acceptance. The current version is always posted here with its effective date and version number, and the previous version is available on request.
